Make It Sand Out

General

When booking with Make It Stand Out, all bookings/hires are subject to the Terms & Conditions set out below:

The Provider

Make It Stand Out Ltd otherwise referred to as “The Company”

The Customer

The person booking Make It Stand Out Ltd for their event. The following contract and its terms comprise an agreement between the Provider and the Customer for the hire of the Photo Booth/Magic Selfie Mirror or other equipment.

This written contract sets out the full, intentions of the parties and supersedes any previous written or oral agreements made between the parties.

Service Period

The Provider agrees to provide any of our equipment, operational and available for use for a minimum of 80% of the agreed service period, to permit maintenance of the equipment should any be necessary. This applies to any equipment we will provide.

Payment

A non-returnable deposit of £50 is required to secure all bookings. The balance of the agreed fee is due 14 days before the Customer’s event. If the operator uses the equipment for a period in excess of the agreed service period additional rental charges will be payable by the Customer to the Provider (Make It Stand Out Ltd), calculated on a pro rata basis.

Payment of all additional rental charges must be made by the Customer before any additional service period commences.

Quotations

Any quotation remains valid for a period of 7 calendar days only unless otherwise stated, and may be withdrawn at any time prior to the expiration of 7 calendar days.

Specifications

The Company reserves the right to alter the specifications of the equipment, where necessary, to comply with regulations or legal requirements or where such alterations do not in the Company’s reasonable opinion materially affect your expressed requirements.

Access, space & power requirements

The Customer will arrange for an appropriate space to be made available for the hired equipment/services at the event venue. The customer is to provide detailed access information (i.e. access route, special requirements). The customer must also let us know if there are any stairs, access to a lift or if the access will involve entering another function/function space (for example, we may need to use a disabled access route which may involve walking through another function). Failure to provide ample space or access for The Company’s use may result in bookings being forfeited with no refund provided.

Parking near to the venue/access route for loading and unloading is required at all events. Should a venue not have its own car park, the customer must make arrangements in order for us to be able to carry out set up/derig at their event.

The Customer will ensure a mains electricity supply comprising a single 13amp socket is located within the space designated by The Customer for the equipment. This applies to all bookings. We do bring extension leads and tape any trailing wires down where necessary, however we do not hold responsibility for any accidents that may occur as we do request that customers and guests take due care when around our equipment. Any power cuts resulting in loss of runtime are not the responsibility of The Company.

Photo Booth/Magic Selfie Mirror Idle Hours

Make It Stand Out is responsible for the delivery, setup, breakdown, and maintenance of the photo booth and Magic Selfie Mirror during the scheduled hire period. Rental hours are counted as consecutive hours with no breaks in run-time. Breaks in the run-time of the photo booth are considered “idle time” and will be an additional charge at the idle hour rate at £15 per hour.  We will arrive at least a half hour (30 minutes) prior to the hire period to setup the photo booth or Magic Selfie Mirror, which is not a part of the rental hours. We can arrive earlier to set up the photo booth or Magic Selfie Mirror at the charge of “idle hours”. The rental includes photo sessions during the rental time period. (For example, the customer may require the run time of a photo booth from 21:00 – 23:00, however may wish for it to be already set up in the room for 19:00, meaning this would incur two hours of “idle time” nb. We would be arriving at 18:30 to be set up for 19:00).

Date Changes & Cancellations

Any request to alter the agreed date of the rental of the Photo Booth/Magic Selfie Mirror or other equipment must be made in writing via email and at least thirty days prior to the Customer’s event.

Any change of date is subject to the availability of the Photo Booth/Magic Selfie Mirror or other equipment on the alternative date and receipt of a new booking contract.

If the Customer cancels an agreed rental of any services or equipment within thirty days before the rental date the entire amount paid will be forfeited.

Any cancelled order is subject to the following cancellation charges:

Within 6 weeks prior to event 50% of full order value

Within 5 weeks prior to event 75% of full order value

Within 4 weeks prior to event 100% of full order value

* All deposit payments are non-refundable – should we be available to move a date, a second deposit will not be required if a first has already been paid. If we are not available on the new requested date, a deposit will not be refunded.

Should a customer wish to cancel, it is their responsibility to contact The Company to do so. Where a customer doesn’t get in contact with us and refuses our contact, efforts will be made to recover any lost funds/unpaid balances by an external debt recovery agent, acting on behalf of The Company.

Cancellations in Relation to Uncontrollable Circumstances

Should a booking be cancelled due to any unforeseen circumstances (e.g. natural disaster, medical lockdown etc.), The Company will not be liable to provide a refund of any sort. We strongly recommend that all our customers take out wedding insurance to ensure no financial loss in any event. Customers who have a booking with us will still be required to make payment as per the terms above, which will then have to be claimed through the customer’s wedding insurance. Where possible, we will transfer the booking to a new date if the event is postponed, however this will be subject to our availability and on a first come/first served basis. No refunds will be awarded should we not be available on the new date.

Changes to Agreed Hire Start Times

Whilst we understand that on the day of the event timings may change, the hire period will start at the agreed time (agreed prior to the event). This is to ensure we can fulfil the needs of other customers as there may be other events on at the same time as the Customers’ event. A maximum of 15 minutes will be added on to a booking where customers have been unable to use the equipment where the day is behind schedule (i.e. speeches over-running). This is at the attendant’s discretion – please be aware we may not always be able to stay for the 15 minutes “extra” as we usually have more than one event running simultaneously. We would recommend to all customers that they take into account the running order of the day and compensate for such issues when agreeing a run time with The Company.

Loss or Damage to the Provider’s Equipment

The Customer assumes complete responsibility for any loss of or damage to the Provider’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the Customer, their employees or their guests.

The Customer shall be responsible for any loss of or damage to the Provider’s equipment caused by Theft, Fire, Flood or Accidental Damage.

Any guests, employees or customers who are excessively incapacitated by alcohol or other means, who are deemed by the event staff to be posing a risk to the Company’s equipment will be asked to leave the area where the equipment is being used. Refusal to do so may result in the hire period ending (this is to protect our assets and staff). In this rare occasion, the customer would not receive any refund for lost hire time (this would only be in an extreme case where we feel that our attendants and/or assets are in any danger and all efforts have been made to diffuse the situation).

The Company does not give permission for The Customer or any external parties to move The Company’s equipment at any point.

Indemnification

The Customer agrees to, and understands the following:

  1. The Customer will indemnify the Provider against any and all liability related to the Customer’s Event and use of the Provider’s equipment.
  2. The Customer will indemnify the Provider against any and all liability associated with the use of any pictures taken at the Customer’s event by the Photo Booth/Magic Selfie Mirror or other equipment or by its operatives, employees or affiliates.

The Customer Agrees to, and Understands the Following:

All persons using any of the Company’s equipment at the Customer’s Event hereby give Make It Stand Out Ltd the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Photo Booth/Magic Selfie Mirror or other equipment user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose.

At every event, we take photos of our “set up” in order to be able to use it for marketing our services. The photos are normally placed on social media, following the event starting.

In addition, the Customer, hereby releases, discharges and agrees to maintain Make It Stand Out Ltd free from any liability arising out of the taking of said picture or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy.

Nut Allergies & Safety Warnings (Candy Cart)

Please note that some of the sweets may contain or have traces of nuts or nut oils; or may have been made alongside other products containing nuts. Make It Stand Out cannot be held responsible for any issues resulting from food allergies.

Customers should also ensure that children are suitably supervised to avoid sweets being chosen which would pose a choking risk. This is even more important for children aged under 5yrs. Similar care should also be taken to ensure children’s safety relating to plastic packaging to avoid any risk of suffocation. Make It Stand Out can not be held responsible for safety issues which occur from the use of equipment, consumables or the consumption of confectionery left at the celebration location.

It is the customer’s responsibility to ensure that, under no circumstances, is the cart to be moved during the celebration by anybody other than The Company’s employees. This has resulted in the past with broken glassware and damage to the cart. All glassware, tongs, scoops etc. are owned by the company and must remain on the candy cart. Under no circumstances must they be removed.

Customers will be liable to reimburse any damages/losses other than reasonable wear and tear; this includes damage to the candy cart, lighting, decoration of the candy cart and any containers/jars used for the display.

Miscellaneous Terms

If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.

This is the entire agreement between the Provider and the Customer relating to the subject matter herein and shall not be modified except as agreed in writing by both parties.

In the unlikely event that it is not possible, other than for reasons beyond the Provider’s control, to provide an operational Photo Booth/other equipment for at least 80% of the agreed service period, the Provider shall make a refund to the Customer calculated pro rata from the total charge made for the agreed service period.

Where the rental includes a photographic printer and for any reason printed photographs cannot be provided on site at the time of the event, the Provider will print the phographs post-event and these will then be supplied to the customer’s address (or agreed delivery location) and delivered by post, free of charge.

Make It Stand Out Ltd is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
