When booking with Make It Stand Out, all bookings/hires are subject to the Terms & Conditions set out below:
Make It Stand Out Ltd otherwise referred to as “The Company”
The person booking Make It Stand Out Ltd for their event. The following contract and its terms comprise an agreement between the Provider and the Customer for the hire of the Photo Booth/Magic Selfie Mirror or other equipment.
This written contract sets out the full, intentions of the parties and supersedes any previous written or oral agreements made between the parties.
The Provider agrees to provide a Photo Booth/other equipment, operational and available for use for a minimum of 80% of the agreed service period, to permit maintenance of the Photo Booth/Magic Selfie Mirror or other equipment should any be necessary. This also applies to hire of light up letters, candy carts and candy floss.
A non-returnable deposit of £50 is required to secure a reservation for the Photo Booth or Magic Selfie Mirror, and all other equipment. The balance of the agreed rental charge is due 14 days before the Customer’s event. If the operator uses the equipment for a period in excess of the agreed service period additional rental charges will be payable by the Customer to the Provider, calculated on a pro rata basis.
Payment of all additional rental charges must be made by the Customer before any additional service period commences.
Any quotation remains valid for a period of 7 calendar days only unless otherwise stated, and may be withdrawn at any time prior to the expiration of 7 calendar days.
The Company reserves the right to alter the specifications of the Equipment, where necessary, to comply with regulations or legal requirements or where such alterations do not in the Company’s reasonable opinion materially affect your expressed requirements.
Access, space & power requirements
The Customer will arrange for an appropriate space to be made available for the Photo Booth or Magic Selfie Mirror at the event venue. A minimum floor area of 2m x 2m is required. For the candy cart, a minimum floor area of 1m x 1m is required, for light up letters and LED uplighters, sufficient floor space is also required depending on the combination of letters hired.
The Customer will provide a mains electricity supply comprising a single 13amp socket located within the space designated by the Customer for the Photo Booth or Magic Selfie Mirror. The customer will also provide a 13amp socket in the space required for hire of light up letters and candy floss machine.
Delivery/Installation of LED Letters
We will deliver and install all LED letters before lunch time on the day of the customers’ event. This is unless it is prior agreed with the customer and subject to availability of staff. Where the customer wishes for the LED letters to be moved later on, either an additional payment must be made or hotel/event staff/nominated persons can move the letters with due care and attention to the letters.
Photo Booth/Magic Selfie Mirror Idle Hours
Make It Stand Out is responsible for the delivery, setup, breakdown, and maintenance of the photo booth and Magic Selfie Mirror during the scheduled rental. Rental hours are counted as consecutive hours with no breaks in run-time. Breaks in the run-time of the photo booth are considered “idle time” and will be an additional charge at the idle hour rate at £20 per hour. We will arrive at least a half hour (30 minutes) prior to the rental to setup the photo booth or Magic Selfie Mirror, which is not a part of the rental hours. We can arrive earlier to setup the photo booth or Magic Selfie Mirror at the charge of “idle hours”. The rental includes unlimited photo sessions during the rental time period.
Date Changes & Cancellations
Any request to alter the agreed date of the rental of the Photo Booth/ Magic Selfie Mirror or other equipment must be made in writing via email and at least thirty days prior to the Customer’s event.
Any change of date is subject to the availability of the Photo Booth/ Magic Selfie Mirror or other equipment on the alternative date and receipt of a new booking contract.
If the Customer cancels an agreed rental of the Photo Booth/ Magic Selfie Mirror or other equipment within thirty days before the rental date the amount paid will be forfeited.
Any cancelled order is subject to the following cancellation charges:
Within 8 weeks prior to event 20% of order value
Within 6 weeks prior to event 50% of order value
Within 4 weeks prior to event 75% of order value
Within 2 weeks prior to event 100% of order value
Loss or Damage to Provider’s Equipment
The Customer assumes complete responsibility for any loss of or damage to the Provider’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the Customer, their employees or their guests.
The Customer shall be responsible for any loss of or damage to the Provider’s equipment caused by Theft, Fire, Flood or Accidental Damage.
The Customer agrees to, and understands the following:
- The Customer will indemnify the Provider against any and all liability related to the Customer’s Event and use of the Provider’s equipment.
- The Customer will indemnify the Provider against any and all liability associated with the use of any pictures taken at the Customer’s event by the Photo Booth/ Magic Selfie Mirror or other equipment or by its operatives, employees or affiliates.
The Customer Agrees to, and Understands the Following:
All persons using the Photo Booth/ Magic Selfie Mirror or other equipment at the Customer’s Event hereby give Make It Stand Out Ltd the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Photo Booth/ Magic Selfie Mirror or other equipment user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose.
In addition, the Customer, hereby releases, discharges and agrees to maintain Make It Stand Out Ltd free from any liability arising out of the taking of said picture or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy.
Nut Allergies & Safety Warnings (Candy Cart/Candy Floss)
Please note that some of the sweets may contain or have traces of nuts or nut oils; or may have been made alongside other products containing nuts. Make It Stand Out cannot be held responsible for any issues resulting from food allergies. Make It Stand Out will retain all packaging for any sweets used, and this will be made available should you require it.
Customers should also ensure that children are suitably supervised to avoid sweets being chosen which would pose a choking risk. This is even more important for children aged under 5yrs. Similar care should also be taken to ensure children’s safety relating to plastic packaging to avoid any risk of suffocation. Make It Stand Out can not be held responsible for safety issues which occur from the use of equipment, consumables or the consumption of confectionery left at the celebration location.
It is the customer’s responsibility to ensure that, under no circumstances, is the cart to be moved during the celebration by anybody other than Make It Stand Out employees. This has resulted in the past with broken glassware and damage to the cart.
Customers will be liable to reimburse any damages other than reasonable wear and tear; this includes damage to the candy cart, lighting, decoration of the candy cart and any containers/jars used for the display.
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.
This is the entire agreement between the Provider and the Customer relating to the subject matter herein and shall not be modified except as agreed in writing by both parties.
In the unlikely event that it is not possible, other than for reasons beyond the Provider’s control, to provide an operational Photo Booth/other equipment for at least 80% of the agreed service period, the Provider shall make a refund to the Customer calculated pro rata from the total charge made for the agreed service period.
Where the rental includes a photographic printer and for any reason printed photographs cannot be provided on site at the time of the event, the Provider will place the photographs on a web site which the Customer and their guests can access to place an order for prints of any photographs which will then be supplied and delivered by post, free of charge. Make It Stand Out Ltd is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
